Additional tenancy terms

Last Updated: 24 August 2026

Extra terms can help both parties understand practical arrangements, but they must be clear, fair and lawful in the jurisdiction where the property is located.

Useful subjects

Terms may cover permitted pets, smoking, parking, garden care, shared facilities, communication and approved alterations.

Legal limits

Do not use an extra term to waive statutory rights, transfer a non-transferable responsibility, or charge an amount that the law does not allow. For example, New Zealand's Residential Tenancies Act 1986 applies to qualifying New Zealand tenancies; it does not set rules for properties elsewhere. Seek local legal advice where a term may affect a statutory right.
